Terms and Conditions
1. Provider and scope
These terms apply to the use of the online service Moneytracker (moneytracker.kainzner.net) and the associated iOS app “Cash Track”. The provider is Christoph Kainzner, Lerchenfelderstraße 128/4/42, 1080 Vienna, Austria, email: christoph@kainzner.net (“we”). Deviating terms of users do not apply.
2. Services
Moneytracker is a tool for personal household and budget planning: accounts, transactions, categories, budgets, reports, and import and export of your data. Moneytracker is not a bank, does not execute payments between your accounts and does not provide financial, tax or investment advice. You are responsible for the accuracy of the data you enter and for decisions based on it.
We strive for availability with as few interruptions as possible but cannot guarantee it; maintenance and disruptions beyond our control are possible. We may develop the service further as long as the agreed core functions are preserved.
3. Registration and user account
A user account with email address and password is required. The contract of use is concluded when registration is completed. You must be of legal age and provide truthful information. Keep your password secret and inform us if you suspect misuse. One user account per person is intended.
4. Free trial
After registering, you can use Moneytracker free of charge with full functionality for two months. No payment details are required for the trial; it ends automatically and does not turn into a paid subscription by itself. We remind you by email before it ends.
Without a subscription, after the trial you can still view, export and delete your data, but you can no longer change it or enter new data.
5. Subscription, prices and payment
The paid subscription is available as a monthly subscription for €2.99 or a yearly subscription for €29.00. All prices are final prices. As a small business under § 6 (1) no. 27 of the Austrian VAT Act (UStG) we do not charge VAT; it is therefore neither charged nor shown. If you subscribe during the trial, billing only starts when the trial ends.
On the web, payment is processed via the payment service provider Stripe; its terms apply in addition. The subscription price is due in advance at the beginning of each billing period and is collected via the stored payment method. If a payment fails, Stripe retries the collection; if payment is still not made, the subscription ends and section 4 paragraph 2 applies.
If the subscription is purchased in the iOS app, payment, renewal and cancellation are handled exclusively by Apple under the App Store terms.
6. Term, renewal and cancellation
Depending on your choice, the subscription runs for one month or one year and renews automatically for the same period unless cancelled beforehand. You can cancel at any time effective at the end of the current billing period – on the web under “My account” → “Manage subscription”, in the iOS app via Apple's subscription settings. Full functionality remains available until the end of the paid period. Periods already paid are not refunded pro rata, except in the case of withdrawal (section 7).
You can also switch between the monthly and yearly subscription under “Manage subscription”; the difference is settled pro rata.
We may cancel the subscription with one month's notice effective at the end of a billing period. The right of both parties to terminate for good cause remains unaffected; good cause exists for us in particular in the event of serious misuse of the service.
7. Right of withdrawal for consumers
As a consumer, you may withdraw from the subscription contract within 14 days without giving reasons. The period begins on the day the contract is concluded. To exercise your right of withdrawal, you must inform us (Christoph Kainzner, Lerchenfelderstraße 128/4/42, 1080 Vienna, Austria, email: christoph@kainzner.net) of your decision by means of a clear statement (e.g. by email). You may use the model withdrawal form below, but this is not mandatory. To meet the deadline, it is sufficient to send the notice before the period expires.
Consequences of withdrawal: If you withdraw from the contract, we will refund all payments received from you without delay and at the latest within 14 days of the day on which we received notice of your withdrawal. We will use the same means of payment that you used for the original transaction; you will not be charged any fees for this. If you requested that the service begin during the withdrawal period (e.g. when subscribing after the trial has ended), you must pay us a reasonable amount corresponding to the proportion of the services already provided up to the withdrawal. If you subscribe during the trial, there is usually no payment yet within the withdrawal period.
Model withdrawal form (if you wish to withdraw from the contract, please complete and return this form):
To Christoph Kainzner, Lerchenfelderstraße 128/4/42, 1080 Vienna, Austria, christoph@kainzner.net:
I/we hereby withdraw from the contract concluded by me/us for the provision of the following service: Moneytracker subscription (monthly/yearly)
Ordered on: …
Name: …
Email address of the user account: …
Date: …
Signature (only if notified on paper): …
8. Obligations of users
You may use the service only for your own lawful purposes. In particular, attempts to circumvent the security of the service, to overload it with automated mass requests or to access other users' accounts are prohibited. Use of the application programming interface (API) with your own access key is permitted within the scope of these terms.
9. Your data
The data you enter belongs to you. We process it exclusively to provide the service; details are set out in the privacy policy. You can export your data at any time under “My account” (JSON/CSV) and delete your user account including all data. We recommend regularly downloading an export as your own backup.
10. Warranty and liability
The statutory warranty provisions apply. We are liable without limitation for intent and gross negligence and for personal injury. In the case of slight negligence, we are only liable for breach of essential contractual obligations and limited to the foreseeable damage typically occurring. We are only liable for data loss to the extent that it would also have occurred with regular backups of your own (export). Mandatory statutory liability provisions, in particular under the Austrian Consumer Protection Act and the Product Liability Act, remain unaffected.
11. Changes to these terms and prices
We may change these terms and the prices for future billing periods if there is an objective reason (e.g. changes in the law, increased costs or new features). We will inform you by email at least six weeks before they take effect. Changes to your disadvantage only take effect if you agree to them; if you do not agree, you can cancel the subscription at the end of the current billing period.
12. Final provisions
Austrian law applies, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer with habitual residence in another EU member state, the mandatory consumer protection provisions of that state remain applicable to you. For consumers resident in Austria, the statutory place of jurisdiction applies. We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board. Should any provision of these terms be invalid, the remaining provisions remain valid.
